Video: Did Police Entrap Occupy Wall Street Protester In Times Square?
Yesterday, thousands of protesters descended upon Times Square and took it over for several hours during one of the biggest Occupy Wall Street rallies to date. There were 45 arrests at the mostly peaceful event, and 92 arrested altogether in NYC over the course of the weekend. But one reader sent us a video alleging that cops entrapped at least one protester. Check out the video below.
The video, taken by Andrew Matsumoto at 46th street and 6th avenue last night, is what he calls "direct evidence of the police using entrapment to make an arrest against a citizen who was completely within their rights and being calm and cooperative." Prior to this video Tim Petryni (the man who was arrested) was denied access to 46th street. When he asked the police officers for a permit they said that they didn't have one. To which he replied that they had to present a permit in order to close the street. Afterwards they agreed to let him through. He asked the officers multiple times if he would be detained if he tried to walk to which they said no, that he wouldn't. Once he crossed them they immediately arrested him. This is a case of entrapment by the police and a complete disregard of a citizens rights. I'm not sure, but I sort of get the feeling their may be some deception here. Seems the man points down the street along the sidewalk, asking if he can go that way, but proceeds instead to attempt to cross the street. Wish there was a better video of it.Sorry, but I feel I must be very careful in passing judgment based on these videos anymore, as so many have turned out to be total setups. You've gotta be joking me, bud.
Cops do that shit all the time. Cops get to go back to the station house and sit down for a few hours filing the arrest report and, processing the prisoner, drinking coffee, and maybe a little porn in the rec room.

Entrapment Explained | On Medical Marijuana
First, it’s not the failure to honestly answer “are you a cop?” Let’s get that straight right off the bat. Second, entrapment is a highly fact specific question. The answer of whether police conduct constitutes entrapment will vary from case to case. But here are the general principles.
Entrapment is a defense to a crime. It has nothing to do with the guilt of the accused party. Rather, it asks whether the police conduct was proper given the circumstances. The purpose of the entrapment doctrine is to deter unlawful government activities.
Entrapment occurs when: (1) the police engage in impermissible conduct which would induce a person similarly situated to the defendant, although otherwise law-abiding, to commit the crime, or (2) the police engage in conduct so reprehensible that it cannot be tolerated.
The first type of entrapment exists if police conduct would induce a person not ready and willing to commit an offense, to commit the offense. It does not exist if the conduct would induce only those persons who are ready and willing to commit the offense to do so. The court will look at a number of factors to make this determination, including whether the police appealed to the defendant’s sympathy, whether there were any long time lapses between the investigation and arrest, whether there were offers of excessive consideration or enticement or whether there existed a guarantee the acts alleged as crimes were not illegal, among other factors.
Under the second criterion, entrapment can be established if the police conduct is so reprehensible that it cannot be tolerated, regardless of its relationship to the crime. Michigan case law tells us that the furnishing of small amounts of contraband, the use of undercover agents and the mere furnishing of an opportunity to commit a crime is not entrapment.
As you can see, an entrapment defense requires a close examination of the facts at hand, usually in an evidentiary hearing before the court. And despite its overblown presence on television, it remains a powerful defense to persons facing criminal prosecutions.
